Ayubik Technologies Private Limited (“Gamopanda,” “we,” “our,” or “us”)

1. Introduction

Ayubik Technologies Private Limited operates a SaaS platform that enables merchants to run purchase streaks, challenges, and automated reward programs for their customers. This Privacy Policy explains how we collect, use, disclose, and safeguard information when you use our platform, website, and related services (collectively, the “Services”).

By accessing or using our Services, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Services.

2. Information We Collect
2.1 Information You Provide Directly
  • Account information: name, email address, company name, and password
  • Billing information: credit card details and billing address (processed by our payment processor)
  • Communications: messages you send to us via support, email, or contact forms
  • Configuration data: streak rules, challenge definitions, reward parameters, and other settings you configure in the platform
2.2 Information We Collect Automatically
  • Log data: IP address, browser type, operating system, referring URLs, pages visited, and timestamps
  • Usage data: features used, API calls made, and interaction patterns within the platform
  • Device data: device identifiers and hardware model where applicable

2.3 Merchant Customer Data

As part of delivering our Services, merchants send us purchase event data about their end customers (e.g., transaction amounts, timestamps, customer identifiers). This data is processed on behalf of the merchant under our Data Processing Agreement. We act as a data processor for this information and process it solely to provide the Services.

2.4 Information from Third Parties

We may receive information about you from third-party integrations you authorize, such as Shopify, WooCommerce, Klaviyo, or other platforms you connect to our Services. The information received depends on the permissions you grant those integrations.

3. How We Use Your Information
  • To provide, operate, and maintain our Services
  • To process purchase events, calculate streak and challenge progress, and trigger rewards
  • To authenticate users and manage account security
  • To process payments and send billing-related communications
  • To respond to support requests and provide customer service
  • To send product updates, feature announcements, and promotional materials (you may opt out at any time)
  • To monitor and analyze usage trends for platform improvement
  • To detect, prevent, and address fraud, security breaches, and abuse
  • To comply with applicable laws, regulations, and legal obligations

  • Contract performance: processing necessary to provide the Services you have requested
  • Legitimate interests: improving our Services, preventing fraud, and communicating with you about our platform
  • Legal obligation: compliance with applicable laws and regulations
  • Consent: where you have provided explicit consent (e.g., marketing communications)
5. Sharing of Information
5.1 Service Providers

We engage trusted third-party vendors to help us operate the Services, including cloud infrastructure providers, payment processors, analytics services, and email delivery platforms. These providers are contractually obligated to process data only as directed by us and in accordance with this Privacy Policy.

5.2 Merchant-Directed Sharing

If a merchant instructs us to share end-customer data with a third-party tool (e.g., a CRM or marketing platform) via our integrations, we do so on the merchant’s instruction as data processor.

5.3 Business Transfers

If Gamopanda is involved in a merger, acquisition, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.

5.4 Legal Requirements

We may disclose your information if required to do so by law or in response to valid requests from public authorities (e.g., a court or government agency), or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

6. Data Retention

We retain personal information for as long as necessary to provide the Services and fulfill the purposes described in this Privacy Policy, unless a longer retention period is required by law. Account data is retained for the duration of the account relationship and for a reasonable period thereafter. Merchant customer event data is retained in accordance with our Data Processing Agreement.

When data is no longer needed, we delete or anonymize it in accordance with our data retention schedule.

7. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate and improve our Services. Types of cookies we use:

  • Essential cookies: required for authentication, session management, and basic platform functionality
  • Analytics cookies: help us understand how users interact with our platform (e.g., Google Analytics)
  • Preference cookies: remember your settings and configurations

You can control cookies through your browser settings. Disabling certain cookies may limit functionality of the Services. We do not currently respond to Do Not Track signals.

8. Data Security

We implement industry-standard technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit (TLS), encryption at rest, access controls, and regular security assessments.

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security. In the event of a data breach affecting your rights and freedoms, we will notify you and applicable regulators as required by law.

Gamopanda is based in India. If you are accessing our Services from outside India, your information may be transferred to and processed in India or other countries where our service providers operate. We ensure appropriate safeguards are in place for such transfers, including Standard Contractual Clauses approved by the European Commission where applicable.

Depending on your location, you may have the following rights regarding your personal data:

  • Correction: request correction of inaccurate or incomplete data
  • Deletion: request deletion of your personal data, subject to legal obligations

  • Withdrawal of consent: where processing is based on consent, withdraw it at any time

If you are an EEA or UK resident and believe we have not adequately addressed your concerns, you have the right to lodge a complaint with your local data protection authority.

11. Children’s Privacy

Our Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children. If you believe we have inadvertently collected data from a child under 16, please contact us immediately at contact@gamopanda.com and we will delete such information promptly.

Our Services may contain links to third-party websites or integrations with third-party platforms (e.g., Shopify, Klaviyo). We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party services you use in connection with our platform.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. We will notify you of material changes by posting the updated policy on our website and, where appropriate, by sending an email notification. The “Effective Date” at the top of this policy indicates when it was last revised. Your continued use of the Services after the effective date constitutes acceptance of the updated policy.
